Question about a rule and breaking it

So the rule is that you're not allowed to overtake a chase.

What are you meant to do if the cop has done a PIT and both cop and suspect are stopped in the apron/grass or near the bottom of the autobahn?

Passing them on the high side while affecting literally nobody or stopping right in the middle of the autobahn for the rule?

I get it if its there to not overtake a chase on a random twisty road going at 120+km/hr but having to suddenly stop in the autobahn is just kind of ridiculous.

I get it thats its is a rule but can it be ''pardoned'' at such situations instead of having a cop cry about it and ask for an apology because of it?
